Effective: October 22, 2026 · Last updated: October 22, 2026
These terms apply to your use of aivisibilityjournal.com, our newsletter and related services (together, the “Service”), published by Nhi Phan, founder, trading as AI Visibility Journal, Delaware, United States (“AVJ”, “we”, “us”). Questions about these terms: [email protected]. By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
1. Our content
Articles, research, charts, design and other material on the Service are owned by AVJ or our licensors and protected by copyright. “AI Visibility Journal”, “AVJ” and our logos are our names and marks; please do not use them in a way that suggests we endorse or are affiliated with you.
You may:
- read, share links to and print our articles for personal or internal business use;
- quote reasonable excerpts with clear attribution and a link, for example: Source: AI Visibility Journal (AVJ), {title}, {date}, {URL};
- use our charts unaltered in commentary, reporting or presentations, with the credit “Chart: AI Visibility Journal (AVJ)” and a link.
Open data. Datasets we publish under a Creative Commons license (normally CC BY 4.0) may be used as that license allows. The license for each dataset is stated on its page and takes precedence over these terms for that dataset.
Without our written permission, you may not:
- republish full articles or substantial parts of them;
- remove copyright or attribution notices;
- present our research or Index as your own, or alter our findings;
- use our content in a way that implies we endorse a product or service.
2. Automated access and AI
Our robots.txt file states which automated agents may crawl the Service. Automated access must respect it, must not place unreasonable load on our systems, and must not circumvent access controls. Allowing crawlers does not transfer ownership of our content or grant rights beyond those in these terms and any dataset license.
3. Newsletter
You can subscribe to The Visibility Brief with an email address and unsubscribe at any time using the link in every email. We do not offer reader accounts or paid subscriptions at present.
4. Your contributions
If you send us tips, comments, data, interview answers or other material, you confirm you have the right to do so, and you allow us to use, edit and publish it in connection with the Service, subject to our Editorial standards and any confidentiality we have agreed with you as a source. Interview guests may agree separate terms with us, which take precedence.
5. Not professional advice
Our content is for information only. It is not legal, financial or other professional advice, and AI systems change frequently. Results described in our research may not apply to your circumstances.
6. Accuracy and availability
We work hard to be accurate and to correct errors promptly (see our Corrections policy). We may change, suspend or discontinue any part of the Service at any time.
DISCLAIMER OF WARRANTIES. TO THE EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
7. Third-party links
We link to other websites for reference. We are not responsible for their content, policies or practices.
8. Limitation of liability
TO THE EXTENT PERMITTED BY LAW, AVJ AND ITS OWNER, EDITORS AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF US$100 OR THE AMOUNT YOU PAID AVJ IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Our content and newsletter are free, so for most readers that amount is $0.
Your consumer rights. Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, or any mandatory consumer protection that applies to you under the laws of your country of residence. This includes your rights as a consumer in the European Union, the United Kingdom and Australia, including under the Australian Consumer Law. Where such laws apply, the disclaimers and limits above apply only to the extent those laws allow.
9. Governing law and venue
These terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Any such dispute will be brought exclusively in the state or federal courts located in Delaware, and you and AVJ consent to their jurisdiction and venue. If you are a consumer in the EU, the UK or Australia, this does not deprive you of the protection of the mandatory laws of your country of residence, or of any right you have to bring proceedings in your local courts.
10. Severability
If any provision of these terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.
11. Changes
We may update these terms. We will change the date above and, for material changes, say so on this page. Continued use of the Service after a change takes effect means you accept the updated terms.
